Monthly Subscription: By purchasing a Monthly Subscription, you agree to an initial and recurring Monthly Subscription fee at the then-current Monthly Subscription rate, and you accept responsibility for all recurring charges until you cancel your subscription. You may cancel

your Monthly Subscription at any time, subject to the terms of our cancellation policy. 

 

Automatic Monthly Subscription Renewal Terms: Once you subscribe and your website is in the ‘Design Cycle’  Digii will automatically process your Monthly Subscription fee in the next billing cycle. Digii will continue to automatically process your Monthly Subscription fee each month at the then- current Monthly Subscription rate, until you cancel your subscription. We explain how to

cancel your Monthly Subscription below at the Section "Cancellation Policy”. Digii reserves the right to increase the monthly fee but will be required to give 6 months notice of any increase. 

 

Fees and Payment

The fees (Fees) for the Services, the price of any Goods (if not included in the Fees) and any additional or other charges set out on the Website or emails at the date we accept the Order or such other price as we may agree in writing. 

Fees and charges include VAT at the rate applicable at the time of the Order.

You must pay by submitting your credit or debit card details with your Order and we can take payment immediately or otherwise before
delivery of the Services.

 

Delivery

29. We will deliver the Services, by the time or within the agreed period or, failing any agreement:

in the case of Services, within a reasonable time.

 

General Restrictions: The rights granted to you by these Terms will remain in force only for so long as these Terms remain in effect. You may not rent, transfer, assign, commercially exploit, resell or sublicense access to the Service to any third-party. You further agree not to combine or integrate the Site and the Services (including the Downloadable Tools) with hardware, software or other technology or materials not provided by us. You may not modify or create any derivative product based on the Site, the Site and the Services (including the Downloadable Tools). You may not decompile, disassemble, reverse engineer or otherwise attempt to obtain or perceive the source code from which any component of the Site and the Services (including the Downloadable Tools) is compiled or interpreted, and nothing in these Terms should be interpreted as granting you any right to obtain or use source code. Except as expressly stated herein, no part of the Site or Services (including the Downloadable Tools) may be copied, reproduced, distributed, republished, downloaded, displayed, posted or transmitted in any form or by any means. Any future release, update, or other addition to functionality of the Site or Services shall be subject to these Terms. 

 

You agree not to use the Site and the Services (including the Downloadable Tools) to: (a) violate

any local, state, national or international law; (b) stalk, harass or harm another individual; (c) collect or store personal data about other users; (d) impersonate any person or entity, or otherwise misrepresent your affiliation with a person or entity; or (e) interfere with or disrupt the Services or servers or networks connected to the Services, or disobey any requirements, procedures, policies or regulations of networks connected to the Services. You promise that any information about yourself that you voluntarily provide to us will be true,

accurate, complete and current.

 

Cancellation Policy: You may cancel your Monthly Subscription at any time by emailing info@digii.online. If you need help, feel free to contact us. If you cancel your Monthly Subscription, the cancellation will take effect for your next Digii monthly billing cycle. You will not be eligible for a refund for monthly subscription fees paid prior to the month the cancellation takes effect. When cancelling the policy your website and all related products that Digii have designed, created and hosted, will be taken down off the internet and no longer in use. As stated above, you may not under any circumstances recreate, copy, or be inspired by any design elements of the site that was created for you or your business through Digii. 

 

In no circumstances will Digii be liable to you or any other third parties for any loss or damage (whether direct or indirect, including loss of profits, loss of opportunity or any consequential loss) resulting from or in any way connected with your use of the Website or its content, whether caused by negligence, misrepresentation, breach of any statutory duty, or breach of contract or otherwise.

You may access other websites via hypertext links from the Website. You use such links and other websites entirely at your own risk. Such websites are provided by independent third parties and Digii accepts no responsibility for the availability, content or use of such websites or information contained on them.

 

Digii reserves the right to vary these terms and conditions from time to time.
